Mr. Treacy was charged with attempted murder at the age of 15. Because he was accused of using a deadly weapon, the offense was classified as a life felony. After the U.S. Supreme Court ruled that a juvenile convicted of a non-homicide offense could not be sentenced to life in prison without the possibility of parole, Mr. Treacy filed a motion for pre-trial release. The trial court denied it. The Fourth District Court of Appeal also denied it as well as a subsequent motion. This appeal followed.
