Stewart was tried, convicted, and sentenced to death for the December 1984 murder of Ruben Dario Diaz. Due to errors in the original proceedings, new hearings had to be held and in March 2001 a jury recommended the death penalty 7-to-5, which the trial judge imposed. This is Stewart's direct appeal.
