Harris was convicted for allegedly attacking a police officer during a police stop involving a search for contraband. The stop itself was later determined to be unlawful. He argued that he could not be convicted under the statute prohibiting battery of police officers during the lawful performance of their duties because the stop was itself unlawful. The trial court and the Fourth District Court of Appeal rejected this claim.
