Hertz was convicted of the fatal shooting of Melanie King and Robin Spears, who were murdered during a robbery of their home in July 1997. A jury recommended death by a 10-2 vote for each murder and he was condemned. The Supreme Court upheld his conviction and sentence and Hertz lost is first post-conviction appeal in trial court.
