Summary:

Mr. Hobbs was charged with sexual activity with a child by a person in a familial relationship and lewd or lascivious battery. The trial court ruled the state could not use Mr. Hobbs' statements to police to prosecute him because his daughter later recanted her accusations. But the Fifth District Court of Appeal reversed the trial court, ruling that prosecutors could use Mr. Hobbs' statements to police.
