G.M., a juvenile, was charged with one count of marijuana possession in 2006. In the trial court, he argued that police violated his constitutional protection against unreasonable seizure by driving up behind the parked car he was sitting in and activating their emergency police lights without a reasonable suspicion of criminal activity. The trial court disagreed. The Third District Court of Appeal upheld the trial court's ruling and this appeal followed.
