Mr. Lebron was convicted and sentenced to death for the 1995 first-degree murder of Larry Oliver. On direct appeal, this Court affirmed the conviction but vacated the death sentence and ordered a new penalty phase trial. Mr. Lebron was again sentenced to death. This Court reversed the sentence and ordered a new penalty phase during which the jury voted 7-5 to recommend death. The trial judge imposed a third death sentence, which was upheld by this Court. Mr. Lebron filed a postconviction motion challenging his conviction and sentence. It was denied by the trial court and this appeal followed.
