Mr. Dorsey was struck in the head after leaving a bar. Mr. Reider's companion was convicted of aggravated battery. Mr. Dorsey sued Mr. Reider, accusing him of negligence in the events leading up to the attack. The jury awarded damages to Mr. Dorsey as compensation for the injuries he suffered in the attack. Mr. Reider appealed and the Third District Court of Appeal reversed the trial court. Mr. Dorsey sought review by this Court, citing conflict with previous case law. Justice Lewis is recused.
