In these consolidated cases, Mr. Masone and Mr. Udowychenko challenge the legality of city ordinances that authorize the use of unmanned red-light cameras to cite and fine owners of cars that are photographed running red lights. The Third District Court of Appeal upheld Aventuraâ€(TM)s ordinance. A few weeks later, the Fifth District Court of Appeal ruled against Orlandoâ€(TM)s ordinance. One of the legal issues in both cases is whether state law preempts these municipal ordinances.
