Mr. Shelly confessed to the fatal shooting of Shanice Smith and was convicted of firstdegree murder; he was also convicted of the attempted murder of Brittany Jackson. He was sentenced to life in prison. He argues the confession should not have been admitted as evidence at trial because police violated his rights to an attorney and to remain silent. The state argues that Mr. Shelly knowingly waived those rights. The Fourth District Court of Appeal rejected his appeal and upheld his convictions. This appeal followed.
