Summary:

The 1996 amendments to the Rules of Procedure created some uncertainty whether attorneys in criminal cases could issue subpoenas on their own, without approval of a clerk of court. In April 1997, the Chief Justice asked The Florida Bar to study the matter and noted that the Court did not intend attorneys to have this power. The Bar developed and approved an amended rule that would expressley give attorneys this authority.
