The West Volusia Hospital Authority ran the West Volusia Hospital for many years, but later leased the entire facility to a private nonprofit, Memorial Hospital-West Volusia, Inc. The latter contended it now was exempt from public records laws and declined to open its records and meetings to news media. The Daytona Beach News-Journal sued. The trial court agreed the meetings and records were now private, but the Fifth District Court reversed.
