CCM Condominium Association sued Petri Pest Control for breach of contract and negligence. At trial, the jury found in favor of CCM. The judge awarded attorney’s fees and other settlement costs to CCM. Petri Pest Control appealed to the Fourth District Court of Appeal arguing that CCM was not entitled to attorney’s fees under Florida law because post-judgment prejudgment interest should not be included when comparing the judgment obtained to the rejected settlement proposal. The Fourth DCA reversed and certified conflict with another appellate court decision and also certified a question of great public importance for this Court to review.
