A jury found Kaczmar guilty of the first-degree murder of Maria Ruiz. He was sentenced to death. This Court reversed that sentence and ordered a new penalty phase. Kaczmar was again sentenced to death. Kaczmar later sought to vacate his first-degree murder conviction and death sentence. The postconviction court granted Kaczmar a new penalty phase. Now, the State and Kaczmar appeal different aspects of the postconviction court’s ruling, raising 31 issues.
