This case considers whether statutory authority and Florida Board of Governors regulations granting Florida Atlantic University (FAU) the power to approve board members and the budget of the Harbor Branch Oceanographic Foundation, Inc., violates the Florida Constitution by impairing the memorandum of understanding between FAU and Harbor Branch which established Harbor Branch as a direct support organization of FAU.
