Cherry was tried, convicted, and sentenced to death for the June 1986 murders of Leonard and Esther Wayne in their small two-bedroom house in DeLand. He also was convicted of charges arising from burglary of their house. His death sentence for the murder was Mrs. Wayne was upheld on appeal, and he now challenges its validity.
