Summary:

In May 1999 the City of Clearwater filed suit to validate a $12 million bond issue to be used for beach redevelopment, including measures that allegedly would reduce vehicular and pedestrian accidents at intersections. The City's charter requires a referendum for bond issues exceeding $1 million except for measures to improve public health and safety, among other things. A citizen challenged the validity of the bond on grounds its primary purpose was aesthetic. The trial court entered an order validating the bond, and the citizen appealed.
