While working as a building inspector for the City, Lombardi suffered an injury when he fell during a home inspection and as a result became permanently and totally disabled. He began receiving benefits from the City but also sued the owners of the home and received a settlement from them. The First District Court of Appeal certified two questions for review involving how to offset the settlement from the benefits due Lombardi.
